1. Overview

This website is operated by OnDek LLC. By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including all policies referenced herein.

If you do not agree to these Terms, you may not access the website or use our services.

 

2. Products & Services

We offer custom and non-custom products, including but not limited to graphics, decals, EVA foam decking and outdoor/marine-related items.

 

We reserve the right to:                                                                                                      

  • Refuse service to anyone for any reason

  • Limit quantities or discontinue products at any time

  • Modify product pricing without notice

CNC Fabrication & EVA Foam Products:

  • Due to the custom nature of CNC cutting, fabrication, and EVA foam manufacturing, material appearance, edge finish, engraving depth, cut lines, foam density, and overall design details may vary from photos, renderings, proofs, samples, or previous production runs.

  • Natural variations in raw materials, including wood grain, metal finish, acrylic color, EVA foam texture, color-variations, foam density, surface finish, and sheet thickness, are normal and may affect the final appearance of the product.

  • EVA foam products may contain slight variations in color shade, firmness, compression, surface texture, thickness, and cut quality depending on material batches and manufacturing processes.

  • CNC machining and cutting processes may produce slight variances in dimensions, tolerances, corner radiuses, kerf width, hole sizes, alignment, bevels, and edge quality.

  • Certain intricate details, small text, thin lines, sharp corners, or complex geometries may require minor design adjustments to accommodate tooling limitations, foam flexibility, material behavior, and machine tolerances.

  • Foam materials may expand, compress, flex, or slightly deform during fabrication, shipping, installation, or regular use, which is considered normal and not a defect.

  • Colors and finishes may appear differently due to lighting, monitor settings, coating batches, paint application, foam production lots, or supplier material changes.

  • Repeat orders or recreated parts may not be identical to prior productions due to machine calibration, tooling wear, material availability, foam batch differences, fabrication methods, or design revisions.

  • Customer-approved proofs, drawings, or digital mockups are for reference purposes only and may not represent the exact final fabricated product.

  • By approving production, the customer acknowledges and accepts reasonable manufacturing, cutting, assembly, and material variations inherent in custom CNC fabrication and EVA foam production processes.

3. Custom Orders & Payments

  • A 50% deposit may be required for custom orders unless otherwise specified.

  • Orders will not begin until payment or deposit is received.

  • Full payment is required prior to delivery or pickup unless otherwise agreed.

 

Credit Card Fees

A 3.5% processing fee will be added to all credit card transactions. This fee does not apply to alternative payment methods such as cash, check, or bank transfer.

4. Custom Orders & Proof Approval

  • All custom orders require client approval of proofs before production.

  • By approving a proof, you accept full responsibility for accuracy (including spelling, layout, and design).

  • All custom orders are final sale and are not eligible for return, refund, or exchange once produced, picked up, or delivered.

 

5. Shipping & Delivery

  • Shipping charges will be calculated at checkout or added to invoices.

  • Shipping fees are non-refundable unless otherwise required by law.

  • OnDek LLC is not responsible for delays caused by carriers, weather, or circumstances beyond our control.

 

Risk of loss transfers to the customer once the product is shipped or picked up.

 

6. Returns & Refunds

  • Custom products are non-refundable and non-returnable.

  • Non-custom items may be eligible for return within 14 days if unused and in original condition.

  • Approved returns may be subject to restocking and shipping fees.

 

7. Taxes

Sales tax will be applied where required by law.
Shipping and handling may also be taxable depending on applicable regulations.

 

8. Intellectual Property

All content on this website, including designs, graphics, logos, and images, is the property of OnDek LLC and may not be used, reproduced, or distributed without written permission.

Custom designs remain the property of OnDek LLC unless otherwise agreed in writing.

 

9. Marketing & Photo Use

By placing an order, you grant OnDek LLC permission to photograph and use images of completed work (including products, boats, and equipment) for marketing and promotional purposes across digital and print platforms.

No personal or identifying information will be shared without additional consent.

 

10. Limitation of Liability

OnDek LLC shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products or services.

Our total liability shall not exceed the amount paid for the product or service.

 

11. Warranties & Disclaimer

Products and services are provided “as is” without warranties of any kind, unless otherwise stated in writing.

​

For EVA foam marine decking products:

  • Materials include a 3-year limited warranty covering material durability under normal use conditions.

  • Professional installations include a 1-year workmanship guarantee covering installation quality.

​

This warranty does not cover:

  • Normal wear and tear

  • Improper use, neglect, or lack of maintenance

  • Damage caused by environmental conditions, accidents, or misuse

  • Unauthorized modifications or repairs

All warranty claims are subject to inspection and approval by OnDek LLC.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas.

 

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page.
